The following terms and conditions exclusively regulate the contractual relationship between the user as a customer and Istrien Delfin j.d.o.o. (simple limited liability company under Croatian law, operator of inistrien.de) as an intermediary for excursions and other services. By completing the booking, the customer commissions Istrien Delfin j.d.o.o. to arrange an excursion or other service provided by a third party tour operator. The customer is bound to the booking order. We expressly point out to all customers that the booking is not made with Istrien Delfin or inistrien.de, but always with the specified provider, taking into account the general terms and conditions of the respective excursion provider.
2.1 The subject of this contract is the brokering of a contract between the customer and the respective provider of excursions and other services.
2.2 The provision of the booked service as such is not part of the obligations of Istrien Delfin. When a booking is made, a contract for the travel service is concluded directly between the customer and the respective provider or tour operator. This contract is based on the respective general terms and conditions of the provider/organiser. The contract is processed exclusively between the respective organizer and the customer. The customer must report defects in the travel service to the respective tour operator.
2.3 By sending the customer’s booking to Istrien Delfin/inistrien.de, the customer accepts our General Terms and Conditions and assures that they have read and understood them. The customer agrees to the use of his data as described in these terms and conditions.
2.4 With the acceptance of the mediation order by Istrien Delfin (sending the booking confirmation to the customer), the customer is bound to the mediation order.
2.5 The mediation order is accepted by e-mail.
2.6 With the booking confirmation, Istrien Delfin confirms the proper forwarding of the booking commissioned by the customer to the respective organizer.
3.1 Istrien Delfin is entitled to demand down payments in accordance with the travel and payment regulations of the mediated service providers.
3.2 In the event of a cancellation, Istrien Delfin can claim from the customer for the customer already paid or still to be paid expenses from the service provider.
No separate fees are charged for Istrien Delfin’s mediation service, as these are usually included in the price of the arranged excursion.
Unless otherwise stated in the excursion description, a full refund will be given if canceled up to 24 hours before the start of the activity. In the case of private tours and boat rentals, the terms and conditions of the provider of the mediated service usually apply. After 24 hours prior to the start of the excursion or service, or in the event of a no-show, no refund will be given.
The provider can cancel the activity on the agreed date without observing a cancellation period if weather conditions or other unforeseeable external circumstances make it impossible or endanger the performance of the activity. In this case, the price paid will be refunded. If possible, an alternative will be offered.
The provider reserves the right to make minor changes to the program if this becomes necessary due to unforeseeable or unavoidable circumstances.
Insofar as Istrien Delfin has not assumed a corresponding contractual obligation by means of an express agreement with the customer, it is not liable for the conclusion of contracts with the service providers to be mediated that correspond to the booking request of the customer. Without express assurance, Istria Delfin as an intermediary with regard to the mediated services is not liable for defects in the provision of services and personal injury or property damage that the customer incurs in connection with the mediated service or is caused by the customer. Istrien Delfin is liable in terms of its position as an intermediary in cases of intent or gross negligence according to the statutory provisions.
The law of the Republic of Croatia applies. Place of jurisdiction is Pula.
